These Terms of Use (“Terms”) govern your access to and use of Queer History Cumbria (“the Website”, “we”, “us”, or “our”), operated in the United Kingdom. By submitting a personal story or browsing you agree to be bound by these Terms. If you do not agree, you must not use the Website.

User-Generated Content (Share Your Story)

Ownership: You retain the copyright in any story (“Content”) you submit.

Licence to Us: By submitting Content, you grant Queer History Cumbria a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable licence to use, reproduce, publish, edit your Content in accordance with the consents agreed to at submission.

Content Standards: You agree not to submit Content that is:

• Defamatory, obscene, offensive, or threatening.
• Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
• Infringes any copyright, database right, or trademark of any other person.
• Breaches any legal duty owed to a third party, such as a contractual duty or a duty of confidence.

Third-Party Content: If your story mentions other people, you warrant that you have obtained their permission to share their personal information.

Privacy and Data Protection

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Please review our Privacy Policy for details on how we collect, use, and store your data, including your rights to access or request deletion of your story (Right to be Forgotten).

Moderation and Removal

We reserve the right (but not the obligation) to review, edit, or remove any Content at our sole discretion, particularly if it breaches our Content Standards.

Intellectual Property Rights

The design, layout, look, appearance, and graphics of the Website are owned by or licensed to us.

Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

Limitation of Liability

While we strive for accuracy, the content on this website is provided “as is”. We are not liable for the accuracy, reliability, or quality of stories submitted by users.

We are not liable for any loss or damage arising from your use of the website or reliance on any content.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud.

Indemnity

You agree to indemnify Queer History Cumbria against all costs, claims, damages, or expenses incurred by us as a result of your breach of these Terms, including submitting infringing or unlawful Content.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales and you irrevocably submit to the exclusive jurisdiction of the courts therein.
